Our Privacy Policy has been designed to make important disclosures to you about how you can use Testified to interact with others and how we collect and can use your content and information. We encourage you to read the Privacy Policy and to use it to help you make informed decisions.

The Services provided by Testified instantly connects people everywhere around the world to what they value and appreciated the most. Any registered user of the Testified Services can send any form of communication to Testified that is public by default and can include other content like images, video, pictures, photos, songs, poetry, testimony and likeness and/or any interview statements and links to other websites. The testimony you provide to Testified will be viewed all around the world.

This Privacy Policy (“Policy”) describes how and when Testified collects, uses and shares your information when you use our Services. Testified receives your information through our various websites, SMS, APIs, email notifications, applications, buttons, widgets, advertisements, commerce services, electronic and non-electronic mediums (the “Testified Services”), and from third parties, other contacts and partners, and our other covered services that link to this Policy (collectively, the “Services”). For example, you send us information when you use our Services on the web, via SMS, or from an application such as Testified for Mac, Testified for Android or similar. When using any of our Services you consent to the collection, transfer, storage, disclosure, and use of your information as described in this Privacy Policy.

You control and are responsible for the information you provide in your testimony and other content you submit through the Services, as provided in the Terms of Service and rules of Testified.

Irrespective of which country you live in, you authorise Testified to use your information in, and as a result to transfer it to and store it in, the United Kingdom, and any other country where Testified operates. Privacy and data protection laws in some of these countries may vary from the laws in the country where you live.

  1. Information Collection and Use

Testified collect and use your information below to provide our Services and to measure and improve them over time.

  1. Basic Account Information

When you create or reconfigure an account, you provide some personal information, such as your name, username, password, email address, or phone number. On the Testified Services, your name and username are listed publicly, including on your profile page and in search results, and you can use either your real name or a pseudonym. Some Testified Services, such as searching and viewing public user profiles, may not require registration.

We collect the content and other information you provide when you use our Services, including when you sign up for an account, create or share, and message or communicate with others. This can include information in or about the content you provide, such as the location of a photo or the date a file was created. We also collect information about how you use our Services, such as the types of content you view or engage with or the frequency and duration of your activities.

  1. Things others do and information they provide.

We also collect content and information that other people provide when they use our Services, including information about you, such as when they share a photo of you, send a message to you, or upload, sync or import your contact information.

  1. Your networks and connections.

We collect information about the people and groups you are connected to and how you interact with them, such as the people you communicate with the most or the groups you like to share with. We also collect contact information you provide if you upload, sync or import this information (such as an address book) from a device.

  1. Contact Information

You may use your contact information, such as your email address or phone number, to customise your account or enable Services, for example, for login verification, Testified via SMS or Digits by Testified. If you provide Testified with your phone number, you agree to receive text messages to that number from Testified. When you use Digits by Testified to sign up for or login to a third-party application, you are directing Testified to share your contact information, such as your phone number, with that application. Testified may use your contact information to send you information about our Services, to market to you, to help prevent spam, fraud, or abuse, and to help others find your account, including through third-party services and client applications. You may use your settings for email and mobile notifications to control notifications you receive from the Testified Services. You may also unsubscribe from a notification by following the instructions contained within the notification or the instructions on our website. Your privacy settings control whether others can find you on the Testified Services by your email address or phone number.

  1. Device information

We collect information from or about the computers, phones, or other devices where you install or access our Services, depending on the permissions you’ve granted. We may associate the information we collect from your different devices, which helps us provide consistent Services across your devices. Here are some examples of the device information we collect:

  • Attributes such as the operating system, hardware version, device settings, file and software names and types, battery and signal strength, and device identifiers.
  • Device locations, including specific geographic locations, such as through GPS, Bluetooth, or Wi-Fi signals.
  • Connection information such as the name of your mobile operator or ISP, browser type, language and time zone, mobile phone number and IP address.
  1. Additional Information

You may provide us with profile information to make public on the Testified Services, such as a short biography, your location, your website, date of birth, or a picture. There are certain profile information fields that Testified will provide you with visibility settings to select who can see this information in your profile. If you provide us with profile information and you don’t see a visibility setting, that information is public. You may choose to upload and sync your address book so that we can help you find and connect with users you know or help other users find and connect with you. We may later tailor content, such as making suggestions or showing user accounts and other users based on imported address book contacts. You can delete your imported address book contacts at any time. If you email us, we may keep your message, email address and contact information to respond to your request. If you connect your account on our Services to your account on another service in order to cross-post between our Services and that service, the other service may send us your registration or profile information on that service and other information that you authorise. This information enables cross-posting, helps us improve the Services, and is deleted from our Services within a few months of your disconnecting from our Services your account on the other service. Providing the additional information described in this section is entirely optional.

  1. Testimonies, Following, Lists and other Public Information

Our Services are primarily designed to help you share your testimony and information with the world. Most of the information you provide us through the Testified Services is information you are asking us to make public. Your public information includes the testimony and information you share; the metadata provided with the testimony and information; the language and time zone associated with your account; and the lists you create, users you follow, any accounts, testimonies or comments you mark as likes or re-shares, and many other bits of information that result from your use of the Testified Services.

We may use this information to make inferences, like what topics you may be interested in, and to customise the content we show you, including advertisements. Our default is almost always to make the information you provide through the Testified Services public for as long as you do not delete it, but in some circumstances we give you settings or features, like direct messages, to make the information more private if you want. In the process of time you will be able to change the language and time zone associated with your account at any time using your account settings.

The Testified Services broadly and instantly disseminate your public information to a wide range of users, customers, and services. For instance, your public user profile information and public testimony and information are immediately delivered via SMS and our APIs to our partners and other third parties, including search engines, developers, and publishers that integrate Testified content into their services, and institutions such as universities and public health agencies that analyse the information for trends and insights. When you share information or content like images, video, photos, pictures, songs, poetry, testimony and likeness and/or any interview statements and links via the Services, you should think carefully about what you are making public.

  1. Location Information

Testified may receive information about your location. For example, you may choose to publish your location in your testimony and in your Testified profile. You may also tell us your location when you set your trend location on Testified website. We may also determine location by using other data from your device, such as precise location information from GPS, information about wireless networks or cell towers near your mobile device, or your IP address. We may use and store information about your location to provide features of our Services, such as informing us about your location, and to improve and customise the Services, for example, with more relevant content like local trends, stories, advertisements, and suggestions for use to follow.

  1. Links

Testified may keep track of how you interact with links across our Services, including our email notifications, third-party services, and client applications, by redirecting clicks or through other means. We do this to help improve our Services, to provide more relevant advertising, and to be able to share aggregate click statistics such as how many times a particular link was clicked on. Links, testimonies, comments, images, video, pictures, songs, poetry, and likeness and/or any interview statements and direct messages shared on the Services will be processed and links may shortened to a http://t….co  link.

  1. Cookies

Like many websites, we use cookies and similar technologies to collect additional website usage data and to improve our Services, but we may require cookies for many parts of our Services such as searching and looking at public user profiles. A cookie is a small data file that is transferred to your computer or mobile device. Testified may use both session cookies and persistent cookies to better understand how you interact with our Services, to monitor aggregate usage by our users and web traffic routing on our Services, and to customize and improve our Services. Although most web browsers automatically accept cookies, some browsers’ settings can be modified to decline cookies or alert you when a website is attempting to place a cookie on your computer. However, some Services may not function properly if you disable cookies. 

  1. Log Data

When you use our Services, we may receive information (“Log Data”) such as your IP address, browser type, operating system, the referring web page, pages visited, location, your mobile carrier, device information (including device and application IDs), search terms, and cookie information. We receive Log Data when you interact with our Services, for example, when you visit our websites, sign into our Services, interact with our email notifications, use your account to authenticate to a third-party website or application, or visit a third-party service that includes a Testified button or widget. We may also receive Log Data when you click on, view or interact with links on our Services, including links to third-party applications, such as when you choose to install another application through Testified. Testified uses Log Data to provide, understand, and improve our Services, to make inferences, like what topics you may be interested in, and to customise the content we show you, including advertisements. If not already done earlier, for example, as provided below for Widget Data, we will either delete Log Data or remove any common account identifiers, such as your username, full IP address, or email address, after a maximum of 18 months.

  1. Widget Data

We may tailor the Services for you based on your visits to third-party websites that integrate Testified buttons or widgets. When these websites first load our buttons or widgets for display, we receive Log Data that includes the web page you visited and a cookie that identifies your browser (“Widget Data”). After about 10 days or so, and in some occasions more than 10 days, we start the process of deleting, de-identifying, or aggregating Widget Data, which is usually instantaneous but in some cases may take up to a week or more. Testified may use Widget Data to tailor content for you, such as suggestions for users to follow and other content you may be interested in. Tailored content is stored with only browser cookies or device IDs and is separated from other Widget Data such as page-visit information.

  1. Information from websites and applications that use our Services

We collect information when you visit or use third-party websites and applications that use our Services (like when they offer our Like button or Testified Login or use our measurement and advertising services). This includes information about the websites and apps you visit, your use of our Services on those websites and apps, as well as information the developer or publisher of the app or website provides to you or us.

  1. Information from third-party partners

We receive information about you and your activities on and off Testified from third-party partners, such as information from a partner when we jointly offer services or from an advertiser about your experiences or interactions with them. 

  1. Testified companies

We receive information about you from companies that are owned or operated by Testified, in accordance with their terms and policies.

  1. Commerce Services

You may provide your payment information, including your credit or debit card number, card expiration date, last three digits of card security code (CSC), and billing address (collectively, “Payment Information”), along with your shipping address, to complete a commerce transaction through our Services. To facilitate future purchases, we store your Payment Information (excluding CSC code) and shipping address, which you can remove from your account at any time using your account settings. Testified consider your Payment Information and shipping address private and do not make such information public.

Testified collect and store information created by your purchases made through our Services (“Transaction Data”). Transaction Data may include the merchant’s name and the date, time, and amount of the transaction. 

  1. Third-Parties and Affiliates

Testified uses a variety of third-party services to help provide our Services, such as hosting our various blogs and wikis, and to help us understand and improve the use of our Services, such as Google Analytics. These third-party service providers may collect information sent by your device as part of a web page request, such as cookies or your IP address. Third-party advertisements partners may share information with us, like a browser cookie ID, website URL visited, mobile device ID, or cryptographic hash of a common account identifier (such as an email address), to help us measure and tailor advertisements. For example, this allows us to display advertisements about things you may have already shown interest in off of our Services. We may also receive information about you from our corporate affiliates in order to help provide, understand, and improve our Services and our affiliates’ services, including the delivery of ads.

  1. How we use this information

We are passionate about creating engaging and customised experiences for people. We use all of the information we have to help us provide, improve, develop and support our Services.

We are able to deliver our Services, personalise content, and make suggestions for you by using this information to understand how you use and interact with our Services and the people or things you’re connected to and interested in on and off our Services.

We also use information we have to provide shortcuts and suggestions to you. For example, we are able to suggest that your friend tag you in a picture or testimony by comparing your friend’s pictures to information we’ve put together from your profile pictures and the other photos in which you’ve been tagged. If this feature is enabled for you, you can control whether we suggest that another user tag you in a testimony or photo and the like using the “Timeline and Tagging” settings.

When we have location information, we use it to tailor our Services for you and others, like helping you to check-in and find local events or offers in your area or tell your friends that you are nearby.

We conduct surveys and research, test features in development, and analyse the information we have to evaluate and improve products and services, develop new products or features, and conduct audits and troubleshooting activities.

  1. Communicate with you

We use your information to send you marketing communications, communicate with you about our Services and let you know about our policies and terms. We also use your information to respond to you when you contact us.

  1. Show and measure advertisements and services

We use the information we have to improve our advertising and measurement systems so we can show you relevant advertisements on and off our Services and measure the effectiveness and reach of advertisement and services.

  1. Promote safety and security

We use the information we have to help verify accounts and activity, and to promote safety and security on and off of our Services, such as by investigating suspicious activity or violations of our terms or policies. We work hard to protect your account using teams of engineers, automated systems, and advanced technology such as encryption and machine learning. We also offer easy-to-use security tools that add an extra layer of security to your account.

  1. Information Sharing and Disclosure

Testified does not disclose your private personal information except in the limited circumstances described below or as stated in the consent agreement.

  1. Sharing On Our Services

People use our Services to connect and share with others. We make this possible by sharing your information in a number of ways:

Public information is any information you share with a public audience, as well as information in your Public profile or content you share on a Testified Page or another public forum. Public information is available to anyone on or off our Services and can be seen or accessed through online search engines, APIs, and offline media, such as on TV.

In some cases, people you share and communicate with may download or re-share this content with others on and off our Services. When you comment on another person’s post or like their content on Testified, that person decides the audience who can see your comment or like. If their audience is public, your comment will also be public.

  1. People that see content others share about you

Other people may use our Services to share content about you with the audience they choose. For example, people may share a photo or testimony of you, mention or tag you at a location in a post, or share information about you that you shared with them. If you have concerns with someone’s post, social reporting is a way for people to quickly and easily ask for help from someone they trust.

  1. Apps, websites and third-party integrations on or using our Services.

When you use third-party apps, websites or other services that use, or are integrated with, our Services, they may receive information about what you post or share. In addition, when you download or use such third-party services, they can access your public profile, which includes your username or user ID, your age range and country/language, your list of friends, as well as any information that you share with them. Information collected by these apps, websites or integrated services is subject to their own terms and policies.

  1. User Consent or Direction

Testified may share or disclose your information at with or without your direction, such as when you authorise a third-party web client or application to access your account. Other users may share or disclose information about you, such as when they mention you, share a testimony, photo or similar content of you, or tag you in a testimony, photo or similar content, etc. Your privacy settings control who can tag you in a testimony, photo or similar content on the Testified Services. If you have shared information, like direct messages or protected information, with another user who accesses the Testified Services through a third-party service, please bear in mind that the information may be shared with the third-party service. 

  1. Service Providers

Testified engage service providers to perform functions and provide services to us in the United Kingdom and other countries. We may share your private personal information with such service providers subject to obligations consistent with this Privacy Policy and any other appropriate confidentiality and security measures, and on the condition that the third parties use your private personal data only on our behalf and pursuant to our instructions. We share your Payment Information with payment services providers to process payments; prevent, detect and investigate fraud or other prohibited activities; facilitate dispute resolution such as chargebacks or refunds; and for other purposes associated with the acceptance of credit or debit cards.

  1. Sharing With Third-Party Partners and Customers

We work with third party companies who help us provide and improve our Services or who use advertising or related products, which makes it possible to operate our companies and provide free services to people around the world.

Here are the types of third parties we can share information with about you:

Advertising, Measurement and Analytics Services (Non-Personally Identifiable Information Only). We want our advertising to be as relevant and interesting as the other information you find on our Services. With this in mind, we use all of the information we have about you to show you relevant advertisements. We do not share information that personally identifies you (personally identifiable information is information like name or email address that can by itself be used to contact you or identifies who you are) with advertising, measurement or analytics partners unless you give us permission.

We may provide these partners with information about the reach and effectiveness of their advertising without providing information that personally identifies you, or if we have aggregated the information so that it does not personally identify you. For example, we may tell an advertiser how its advertisements performed, or how many people viewed their advertisements or installed an app after seeing an advertisement, or provide non-personally identifying demographic information (such as 45 year old male, in Texas, who likes virtual reality applications) to these partners to help them understand their audience or customers, but only after the advertiser has agreed to abide by our advertiser guidelines.

  1. Vendors, service providers and other partners

We transfer information to vendors, service providers, and other partners who globally support our business, such as providing technical infrastructure services, analysing how our Services are used, measuring the effectiveness of advertisements and services, providing customer service, facilitating payments, or conducting academic research and surveys. These partners must adhere to strict confidentiality obligations in a way that is consistent with this Data Policy and the agreements we enter into with them.

  1. Commerce Transactions

If you make a payment as part of a commerce transaction through Testified Services, we may provide the seller, commerce provider, marketplace, or charity with your name, email address, shipping address, Payment Information and Transaction Data to facilitate payment processing, order fulfilment, and dispute resolution (including payment and shipping disputes) and to help prevent, detect, and investigate fraud or other prohibited activities. We advise you to please refer to these third parties’ privacy policies for information about their privacy practices.

  1. Law and Harm

Notwithstanding anything to the contrary in this Policy, we may preserve or disclose your information if we believe that it is reasonably necessary to comply with a law, regulation, legal process, or governmental request to protect the safety of any person; to address fraud, security or technical issues; or to protect Testified’s rights or property. However, nothing in this Privacy Policy is intended to limit any legal defences or objections that you may have to a third party’s or government’s request to disclose your information.

We may access, preserve and share your information in response to a legal request (like a search warrant, court order or summons) if we have a good faith belief that the law requires us to do so. This may include responding to legal requests from jurisdictions outside of the United Kingdom where we have a good faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognised standards.

We may also access, preserve and share information when we have a good faith belief it is necessary to: detect, prevent and address fraud and other illegal activity; to protect ourselves, you and others, including as part of investigations; or to prevent death or imminent bodily harm. For example, we may provide information to third-party partners about the reliability of your account to prevent fraud and abuse on and off our Services.

Information we receive about you, including financial transaction data related to purchases made with Testified, may be accessed, processed and retained for an extended period of time when it is the subject of a legal request or obligation, governmental investigation, or investigations concerning possible violations of our terms or policies, or otherwise to prevent harm. We also may retain information from accounts disabled for violations of our terms for at least a year to prevent repeat abuse or other violations of our terms.

  1. Business Transfers and Affiliates

In the event that Testified is involved in a bankruptcy, merger, acquisition, reorganisation or sale of assets, your information may be sold or transferred as part of that transaction. This Privacy Policy will apply to your information as transferred to the new entity. We may also disclose information about you to our corporate affiliates in order to help provide, understand, and improve our Services and our affiliates’ services, including the delivery of advertisements.

  1. Non-Private or Non-Personal Information

Testified may share or disclose your non-private, aggregated or otherwise non-personal information, such as your public user profile information, public testimonies or information, the users you follow or that follow you, or the number of users who clicked on a particular link (even if only one did), or reports to advertisers about unique users who saw or clicked on their ads after we have removed any private personal information (such as your name or contact information).

  1. 12. Accessing and Modifying Your Personal Information

If you are a registered user of Testified Services, we provide you with tools and account settings to access, correct, delete, or modify the personal information you provided to us and associated with your account. You can download certain account information, including your testimonies and request access to additional information.

You can also permanently delete your Testified account at any time. If you follow the instructions for deactivating your account, your account will be deactivated and then deleted. When you delete your account, we delete things you have posted, such as your photos and status updates.

If you do not want to delete your account, but want to temporarily stop using Testified, you may deactivate your account instead. When your account is deactivated, it will not (or in some circumstances it may not) be viewable on Testified. In most cases it will be possible to restore your account for up to 30 days after it was accidentally or wrongfully deactivated. In the absence of a separate arrangement between you and Testified to extend your deactivation period after 30 days, we begin the process of deleting your account from our systems, which can take up to a week or more in some circumstances.

It is important to bear in mind that search engines and other third parties may still retain copies of your public information, like your user profile information and public testimony and information, even after you have deleted the information from the Testified Services or deactivated your account.

Keep in mind that information that others have shared about you is not part of your account and will not be deleted when you delete your account.

  1. Our Policy Towards Children

The Services that Testified provides are not directed to persons under age 13. If a person under age 13 wishes to provide a testimony or access Testified they must get parental consent or consent from their guardian or anyone who holds such responsibility over them as deemed by the jurisdiction in which that child resides.

If any user above age 13 years becomes aware that your child or a child has provided us with personal information without your consent, please contact us with the contact details provided by the Testified website. We do not knowingly collect personal information from children under 13 years of age. If we become aware that a child under 13 years of age has provided us with personal information, we take steps to remove such information and terminate the child’s account.

  1. Changes to this Policy

Testified may revise this Privacy Policy from time to time. The most current version of the policy will govern our use of your information and will always be at the Testified website. If we make a change to this policy that, in our sole discretion, is material, we will notify you via an @Testified update or email to the email address associated with your account. By continuing to access or use the Services after those changes become effective, you agree to be bound by the revised Privacy Policy.
